The Fair Housing Act

The Fair Housing Act (Title VIII of the Civil Rights Act of 1968), as amended by the Fair Housing Amendments Act of 1988, prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on the following federally protected classes:

Race

Discrimination based on a person's race is prohibited in all housing-related activities.

Color

Discrimination based on skin color is prohibited, regardless of race or national origin.

Religion

Housing discrimination based on religious beliefs, practices, or affiliation is prohibited.

National Origin

Discrimination based on a person's country of birth, ancestry, or ethnic background is prohibited.

Sex

Discrimination based on sex, including sexual harassment, is prohibited in housing transactions.

Familial Status

Discrimination against families with children under 18, pregnant women, or those securing custody of children is prohibited.

Disability

Discrimination against individuals with physical or mental disabilities is prohibited. Reasonable accommodations and modifications must be permitted.

Under the Fair Housing Act, It Is Illegal To:

  • Refuse to sell or rent a dwelling to any person because of race, color, religion, sex, familial status, national origin, or disability.
  • Discriminate in the terms, conditions, or privileges of the sale or rental of a dwelling, or in the provision of services or facilities in connection therewith.
  • Make, print, or publish any notice, statement, or advertisement with respect to the sale or rental of a dwelling that indicates any preference, limitation, or discrimination.
  • Represent to any person that a dwelling is not available for inspection, sale, or rental when such dwelling is in fact available.
  • Deny access to, or membership or participation in, any multiple listing service, real estate brokers' organization, or other service related to the sale or rental of dwellings.
  • Coerce, intimidate, threaten, or interfere with any person in the exercise or enjoyment of any right granted or protected by the Fair Housing Act.
  • Refuse to make reasonable accommodations in rules, policies, practices, or services when such accommodations may be necessary to afford a person with a disability equal opportunity to use and enjoy a dwelling.

Florida Fair Housing Act

In addition to federal protections, the Florida Fair Housing Act (Chapter 760, Florida Statutes) provides protections consistent with the federal Fair Housing Act. The State of Florida enforces fair housing laws through the Florida Commission on Human Relations (FCHR). Michael Riordan P.A. complies with all applicable federal and state fair housing laws in every aspect of our real estate practice.

2026 Regulatory Update

On April 6, 2026, the U.S. Department of Housing and Urban Development (HUD) published a Federal Register notice (Docket No. FR-6571-N-01) withdrawing several prior Fair Housing and Equal Opportunity (FHEO) guidance documents as part of ongoing regulatory reform efforts. The withdrawal was effective September 17, 2025.

The withdrawn guidance documents addressed topics including digital advertising, assistance animals, source of income testing, and other interpretive guidance. It is important to note that the Fair Housing Act itself remains fully in effect, and all statutory protections continue to apply. The withdrawal pertains only to non-binding agency guidance, not to the underlying law.
